The King of PsrssiA Nox-Scttid ijc a St. Lous Court. ?Some time since his Majesty, Frederick William IV., King of Prussia, brought his action in the Circuit Court of St. Lcuis, against Felix Cosie, administrator of Frederick William Kup per, claiming 7,4l)U thalers. moneys al leged to have been embezzled by the de ceased from the post-office of the King, which moneys belonged to the various subjects of the King, and were, after the embezzlement, reimbursed by the King to the parties who were sufferers by the embezzlement of Kupper. The petition of the King alleged that he is an absolute monarch of the kingdom of Prussia, and as King thereof is the sole government of that country; that he is unrestrained by any constitution or law, and that his will, expressed in due fjrrn, is the only law of that couutry, and is the only le*al power there known to exist as law: that by the law of Prus sia auy iuonoy, or its equivalent, sent through the Post Department of Prus sia, if lost or stolen, is to be refunded to the owner by the King. Kupper, it ap pears, was r postmaster in Prussia, and absconded with the money committed to his care in 1849. He came to St. Louis, and die 1 the same year, when Ocste be came his administrator. The case was ably argued. The court held that the petition did not show any cause of action at common law; that the payment of the money to the true owners, by the King, did not at com mon law authorize the King to recover it of the defendant; and that this court had no jurisdiction over the questions as to the extent of the powers of the King of Prussia in his sovereign capacity; to cre ate a legal liability against a party by the excercise of his will in any form; or as to the power of the King, as a sover eign, to decree; that Kupper was liable to pay him as a sovereign, that while the King could sue in this court in his cor porate capacity waiving his sovereignity, for the recovery of any demand recog nised by our laws, yet in a case like the present, the action is based upon the powers of the King as a sovereign of a foreign State, he must prosecute the claim before the tribunal having the sole jurisdiction of such questions, and a State court cannot take cogniianco of thejQ.
