And what has been tho effect of this great wrong? Why, nothing more nor lea# (aa we shall prove) thim an eipoeiro of the ooat o( manufacture, and a consequent deatractioa of trada with America; for American dealers, being let into tho secret of the cheapness at which mnaieal instrument* could be produced by the Messrs. Alexandre, forthwith made purchase* at a mere trifle above cast. ? Tho goods ought never to have been seised, for another reason. In compliance with the spirit of the eighth section oC the tariff act of 1846, which authorises the consignee or agent to make such addition in the entry to tho coot or value given in the Invoice, aa to ralae the same to tho true market value abroad, we shall show in evidence that before the commencement of this ault an offer, ia writing, waa made to tho Collector to aoquieaco in tha appraisement, however unjust, and pay tho dutiee thereon. You, gentlemen of the jury, can judge foe yourselves whether that wan evidence of fraud. Wo Khali also show that t be printed circular or cataloguer iaauad by Mestra. Alexandre, according to the euatom of Parisian manufacturers, aud ui.rd by the Custom Housa officers in settling the appraisement, ia no critorioa whatever of price or value, but states a wholly flatltioua value; that the organs there in tad at 1.100 franoa could be, and actually have bees, purchased for 446 franoa, and the other qualities at proportionate deductions; that the discounts allowed by that bouse reach as high aa aixty per eent; that such piactice of a nominal price current was officially known to the govern ment, through their Consul at Paris, and disregarded by the appraising officer; and also that such merchan dise haa no market value, owing to tho extremely lim ited demand, but is aold for what it will bring. Now * rercrt to a fow figures will in a moment tall precisely how wo stand. The invoice is fixed at 2,860 franca. Tha same articlea are set forth In the printed catalogue at 7,600 tranca. A deduction of sixty per cant would re duce the same to selling price, which would form tha standard, or, if you please, market valuo, and thus tha amount would be 3,040 franca, a difference of only 89 francs, or less than 38 dollars, beyond tho Invoice. Consequently the matter Is resolved into a trifling difference which the Conrt has already decided will not be sufficient to authorise the jury in inferring frau 1. It is eminently proper, gentle men of tha jury, that yen should not lose sight of the fact that although yon have the power of rendering averdlct in oue favor, yet, Rowing to the inequality of righto which exlats between individuals and the government, tha former, no matter how successful, munt always be tha losers ; and that Messrs. Alexandre will, neverthelesa, in oroer to prove their innocence, be aubjoctod to ex penses about equal to tlie valuo of tho Invoice. Several witnesses were examined on behalf of the claimants, and upon the summing up of Mr. Kursheedt and Mr. Joaehimaien, and the' charge of His Honor the Judge, the esse was submitted to the Jury.
