Thii was action brought in 1862 for the for feiture of certain mniieal instruments or organs sent to this port from Paris, upon the ground of undat valuation, with intent to defraud the revenue. Mr. Joachims ten appeared for the I'aited State*, and Mr. Alexander Kursheedt and Mr. Jamei Ridgway for the claimant*. The fact* may mostly be gathered from a sketch of the opening or the defence. The prosecuting officer having opened his ease, and produced tufflcieat testimony to throw the burden of proof upon the claimants, Mr. Ridgway, in opening the ease for the claimants, said ? The fact- are really to few, plain and simple, there will bo no difficulty in arriving at a satisfactory conclusion. Before proceediug to give an outline of the evideaee we intend to oflsr, it is jut that 1 should call the attention of the court to the charge deli vered by his Honor, Judge Betta, in a ea*e similar to this, recently tried kef ere bin, as forming part of the instructions which it will be proper for yoer Henor to submit to the jury. The counsel then rsad the charge of his Honor in the case of tlandsrson's fort* and grindstones, In reference to the smallness of differ ence between the invoice and appraisal being no evi dence of fraud, Ac. The principle, then, is an estab lished one, that, to convict, the jury mu?t flni the in voice was not only lew, but low with intent to get the goods in at i low prioe, and, also, that if dif srruce in the aaeount is small they aro not to infer fraud. They had sent two other consignments to the United Statee in the same way. The ftrst by the ship William Tell, In March, 18(2, of nine organs, Invoiced at 2,8(1 francs, upon which chargee w?re Incurred here, swelling the cost to 4,200 francs. Those goods only brought 8,400 francs, so that lie Mrs. Alexandre lost 800 francs. The second ahipment of two lnatrom*ats by ths ?auclu*e, in August of the same year, was mvoieed at 700 franc*? the charge* increaaing that amount to 1,000 francs. Thoee two sold for 1,862, leaving a profit to ths msnnfscturer* of 882 francs. In this second impu tation jou perceive the chances of trade and transpor tation were in their favor, instead of againat them, as in ths first ahipment. It will bo *een that throughout the whole of their transactions with the I'nlted (Hates, th'j went upon the assumption that manufacturers were entitled to invoice their own goods at actual cost, aad Ui?y had good reason for believing so; for. In two instaaees prior to this cass, they had adopted that as sumption, and were given to understand that it was cor rect, by the fact of the Kew York Custom Hou*e autho rity* examining the goods and passing the invoices un questioned. They received their information, in all pro bability, from ?osae of our earlier laws, and were thus innocently led Into the error of supposing no essential change had been mede.
